Defamation is a false and unprivileged statement of fact that is harmful to someone's reputation, and published "with fault," meaning as a result of negligence or malice. Libel is a written defamation. The elements of which are: 1. a publication to one other than the person defamed 2. a false statement of fact 3. that is understood as: a. being of and concerning the plaintiff; and b. tending to harm the reputation of plaintiff. And, here is a real life example (identities are protected): I answered you on the lens (Doing It Anyway / Bullies at Work). I won't copy you here, but rather invite you to view it (at your leisure) when you wish. ******, this is the online bully I wrote about in * * * * * * * * * * * . She comes across as wonderful, and then stabs you in the back if you happen to disagree with something she says.
