I recently had the question posed about laws.

Defamation is a false and unprivileged statement of fact that is harmful to someone's reputation, and published "with fault," meaning as a result of negligence or malice. Libel is a written defamation. The elements of which are:

1. a publication to one other than the person defamed
2. a false statement of fact
3. that is understood as:
a. being of and concerning the plaintiff; and
b. tending to harm the reputation of plaintiff.

And, here is a real life example (identities are protected):

I answered you on the lens (Doing It Anyway / Bullies at Work). I won't copy you here, but rather invite you to view it (at your leisure) when you wish.

******, this is the online bully I wrote about in * * * * * * * * * * * . She comes across as wonderful, and then stabs you in the back if you happen to disagree with something she says.

  1. sousababy  Thanks for liking this Raphaelo. In the very least, it all makes an interesting case study.

  1. Peter Egan Jr.  @shaor3 They can do what they wish. I will never curb my speech out of fear that someone may sue me. In fact, I have been throwing around an idea to actually bait public figures into suing me for defamation and/or in order to secure rights to domain name(s) that I own that may or may... more

From the Terms of Service link within Amplify.com. Just for clarity, the constitutional and statutory privileges that may protect you (condensed):

Generally, defamation is a false and unprivileged statement of fact that is harmful to someone's reputation, and published "with fault," meaning as a result of negligence or malice. State laws often define defamation in specific ways. Libel is a written defamation.

The elements of defamation are:

1. a publication to one other than the person defamed

2. a false statement of fact

3. that is understood as:

a. being of and concerning the plaintiff; and
b. tending to harm the reputation of plaintiff.

Just thought everyone should be aware of their rights. Hope it helps! (Sorry, no time to visit your fabulous lenses and blogs - gotta keep on working).

Stealing my robes didn't work; trying to discredit me as a teacher failed; so now the haters are trying character assassination. Sickening. Here's their latest disgusting round of lies: http://bit.ly/gl3Z1Q

These cowards hide behind pseudonyms, and refuse to allow me to respond. They provide no substance to their baseless claims, and reject my offer for them to come VIDEO record the proof of the veracity of my work, my lineage, my apostolic succession and integrity. Thirty years of monastic life leave LOTS of evidence and proof!

If anyone knows a compassionate attorney who might take a case pro-bono to go after these people for libel, let me know. I intend to sue them for all they are worth.

  1. Michael Johnson  @dharmacharya That post is now gone. I hope my efforts were the result of that…

  2. Khenpo Gurudas Sunyatananda  Thank you both. I didn’t see your post there, but am certain it must have been the impetus for the “moderators” (if they even deserve such recognition) finally taking action. Saddest of all is the karma they are causing to ripen upon themselves with such hatred and mean-spiritedness.

Here is a great little article about a Car Company who can't take a joke. Do they really have anything to be angry over anyway, unless they can prove that they lost sales due to Top Gear's review of their vehicle.

Florida State Court Judge Gill Freeman has ruled against Barry Minkow in a libel and extortion lawsuit brought by Lennar Corp. Minkow, the ZZZZ Best carpet-cleaning California con-man turned pastor and fraud buster, was found guilty of giving false testimony, withholding documents, destroying evidence, concealing the identity of key witnesses, wilfully violating court orders and trying to “cloud his misconduct.” Among other things, he was engaged in ultimate fraudster screw-up when he “i... read full post

Very soon your actions or tweets could become libel in other countries.
